General conditions of sale
Art.1 SCOPE OF APPLICATION
Unless otherwise agreed in writing, orders are governed without exception by the general conditions of sale below, which prevail over any other stipulation or documents from our customers. These general conditions of sale apply exclusively to current and future commercial relations between PARICI, a sole proprietorship , whose registered office is located at 52 rue Mouffetard 75005 PARIS, registered in the Paris Trade and Companies Register under number 398 805 457, hereinafter referred to as PARICI and the author of the order, hereinafter referred to as the Customer. Any order placed by the customer implies their acceptance without restriction or reservation of these general conditions of sale.
Â
Art.2 PRICE
Prices indicated are in euros net to be paid, excluding shipping costs. They take into account possible discounts as well as French VAT, applicable on the day of the order. Any order placed on the PARICI website and delivered outside of France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination. These customs duties and possible taxes related to the delivery of an item are the responsibility of the customer. PARICI is not required to verify and inform the customer of applicable customs duties and taxes. PARICI reserves the right to modify its prices at any time, depending on economic or regulatory conditions. Invoicing is carried out according to the rate in effect on the day of the order. All prices are given subject to obvious typographical errors.
Â
Art.3 PRODUCTS
The photos of the items shown on the PARICI website are not contractually binding and are subject to change at any time upon request from the manufacturer. Similarly, the products available on the PARICI website are covered by the legal warranties of their respective manufacturers.
Art.4 ORDER
The most common ordering method is online at: www.souvenirparis.com.
The customer can also order by telephone every day from 10:00 a.m. to 7:00 p.m. at 01.43.31.79.85 (cost of a local call).
PARICI reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.
Â
Art.5 VALIDATION
The customer declares to have read and accepted these general conditions of sale before placing his order. Validation of his order therefore constitutes acceptance of these General Conditions of Sale.
Unless proven otherwise, the data recorded by PARICI constitutes proof of all transactions carried out by PARICI and its customers.
Â
Art.6 AVAILABILITY
Product offers and prices are valid as long as they are visible on the site, within the limits of available stocks. The customer declares to have read and accepted these general conditions of sale before placing his order. Validation of his order therefore constitutes acceptance of these General Conditions of Sale.
Â
Art.7 PAYMENTS
Payment is due upon ordering. The order is only processed upon receipt and validation of payment, which must be made by credit card via the secure payment module by LCL bank. The customer's banking information is never communicated to PARICI, but processed directly by the bank's secure and encrypted server, Sherlock's . It is also possible to pay for your order by bank transfer, which results in longer order processing times.
Â
Art.8 DELIVERY
Delivery is made to the address indicated by the customer when ordering. From the date on which the ordered products leave our warehouses, PARICI can no longer be held responsible for delays or damage caused during transport. Delivery times are given for information purposes only. All our shipments are made by La Poste via priority mail, Colissimo or Chronopost depending on the service provider adapted to the destination of the package and depending on the choice of service provider made by the customer. In the event of an unexpected stock shortage or one not reported on the page of the article by mistake, for an ordered item, the customer will be notified immediately by PARICI customer service, in order to inform them of the possible delay and allow them, if necessary, to cancel their order and obtain an immediate refund of the amounts already paid.
Art.9 COMPLAINT, WITHDRAWAL PERIOD
The customer has a 7-day withdrawal period to cancel their order after receiving it (return of items in their original packaging in new condition, accompanied by the original invoice and a bank account number). After this period, no refund or return of goods will be considered without prior agreement. The cost of returning the products is the responsibility of the customer (except in the event of an error on our part: incorrect reference, data entry error). No goods returned carriage due will be accepted by our After-Sales Service. Any return request, including within the legal withdrawal period, must be submitted to PARICI in writing (email or letter) for acceptance.
Art. 10 RESERVATION OF OWNERSHIP
PARICI reserves ownership of the goods sold, delivered and designated on its invoices until their effective and full payment (application of law n° 80-3355 of May 12, 1990). In the event of disagreement on the terms of return of the products following a payment incident, this may be obtained by interim order issued by the President of the Paris Commercial Court to which the parties expressly attribute jurisdiction. The costs incurred by the need for recovery in litigation remain the responsibility of the customer (including the fees of ministerial officers and interest for late payment).
Â
Art. 11 DATA PROTECTION AND FREEDOMS
In accordance with Law No. 78-17 of January 6, 1978, relating to information technology, files and freedoms, the processing of personal information collected on the site has been declared to the National Commission for Information Technology and Freedoms. The user has the right to access, modify, rectify and delete data concerning him/her. To exercise this right, the user must send an email to the following address: remi@souvenirparis.com.
Â
Art.12 JURISDICTION, CONTESTATION
Customers who order via the PARICI website (www.souvenirparis.com) in French are deemed to be purchasing in France and are therefore subject to French law. In the event of any dispute or challenge to the order, the courts of Paris will have sole jurisdiction. This clause applies even in the event of summary proceedings, incidental claims, or multiple defendants.
